Cholendra Shumsher Rana impeachment case puts Parliament
The case could determine how Parliament’s impeachment powers apply after a House term ends and how far the judiciary can review parliamentary decisions KATHMANDU: The Constitutional Bench of the Supreme Court will resume hearing on the impeachment case against former Chief Justice Cholendra Shumsher JB Rana on Wednesday, September 9, after the case remained under continuous hearing following its August 26 hearing. The bench has been convened for a hearing tomorrow after proceedings were affected by the Bhote Koshi River flood. According to Supreme Court Spokesperson and Joint Registrar Arjun Prasad Koirala, the Constitutional Bench had begun sitting on the petition against Rana on August 19. The Constitutional Bench convenes every Wednesday at the Supreme Court. Whether the impeachment hearing will conclude on September 9 cannot be said for sure right now. “The petition has been under continuous hearing twice in a row, and the bench is convening again tomorrow,” Koirala says. “If it does not finish tomorrow, it may remain under continuous hearing and be heard on another day.” Government attorneys have already presented their arguments before the Constitutional Bench. They argued that after the term of Parliament ended, the rationale for the impeachment ceased to exist. Arguments from government attorneys are still remaining. Following this, advocates from the petitioner’s side will present their counterarguments. The petitioners argue that in judicial practice, an impeachment motion never becomes irrelevant, and because it involves a criminal offense, the concerned person must either be found guilty or the charges dismissed.
